General terms and conditions of sale

Last updated: 3 Oct, 2026.

1. Purpose and scope of application

These general conditions of sale (the "Terms") govern the entire contractual relationship between Kyronix Labs LLC, which operates the online store "The Little Night" at shopify-little-night-hzjh.vercel.app(the "Site"), and any natural person who is not a trader and who acts for purposes outside their professional activity (the "Customer") when they place an order on the Site.

These Terms apply to every sale of products offered on the Site and concluded at a distance. They define the rights and obligations of the parties in the sale of products to the Customer. Any order placed on the Site requires the Customer to have read and fully accepted these Terms. By confirming an order, the Customer acknowledges that they have read the Terms and accept them without reservation.

Kyronix Labs LLC may adapt or change these Terms at any time. If they change, the Terms that apply are those in force on the date of the order — the version available on the Site when the Customer confirms the order. The fact that the seller does not rely on one of these clauses at a given moment cannot be read as a waiver of the right to rely on it later.

2. Identity of the seller

The Site and the store "The Little Night" are operated by Kyronix Labs LLC, a limited liability company registered in the State of New Mexico, United States, whose Employer Identification Number (EIN) is 98-1961162. The Customer can reach the seller by email at hello@thelittlenight.com, which is the preferred contact for any question about an order, these Terms, or performance of the contract.

The trade name "The Little Night" is the name under which Kyronix Labs LLC sells its products to Customers. The Site is hosted on third-party infrastructure, and the checkout and collection of payments are handled by the Shopify platform. Information about the publisher of the Site, hosting, and data processing also appears on the legal notice and privacy pages.

3. Products and descriptions

The products offered for sale are those shown on the Site on the day the Customer views it, within the limits of available stock. Each product comes with a description of its essential characteristics: nature, composition, dimensions, recommended use, and care. The Customer is invited to read that description carefully before ordering.

Photographs, illustrations, and visuals are provided for information only and are not part of the contract. They aim to show the product as faithfully as possible, but slight differences in appearance, shade, or rendering can exist, in particular because of the Customer's screen settings. The seller cannot be held liable for that. If there is any doubt about a product's characteristics, the Customer can contact customer service before ordering.

4. Price

Product prices are shown on the Site in euros, including any applicable taxes. The price that applies is the one displayed on the Site when the Customer confirms the order. Prices may change at any time. Products are invoiced at the rates in force when the order is recorded.

Delivery is free in metropolitan France: no delivery fee is added to the displayed price for orders shipped to that area. The total amount due by the Customer, including every sum that may be payable, is summarized on the payment page before the order is finally confirmed, so the Customer knows the exact price they will pay.

5. Order

To place an order, the Customer selects the product or products they want, adds them to the cart, then goes through checkout and enters the information needed for delivery and payment. Before confirming, the Customer can check the order details and the total price, and correct any errors, before confirming acceptance.

Confirmation of the order by the Customer, together with payment, concludes the contract of sale and accepts these Terms, the prices, and the descriptions of the products offered. The sale is final after the seller emails the Customer confirmation that the order has been accepted, and after the full price has been collected.

The seller may cancel or refuse any order from a Customer with whom there is a dispute about payment of a previous order, or in the case of an order that is clearly abnormal, fraudulent, or made in bad faith. Data recorded in the seller's computer systems and those of its providers, under reasonable security conditions, is proof of all transactions concluded between the seller and the Customer. The order and the invoice are archived on a reliable and durable medium, so as to match a faithful and lasting copy. The Customer can access this information by writing to hello@thelittlenight.com.

6. Payment

The price is paid online, in full, when the order is confirmed. Payment goes through the secure checkout provided by the Shopify platform. Accepted methods include bank card, PayPal, Apple Pay, Google Pay, and Shop Pay. The Customer guarantees that they have the authorizations needed to use the payment method they choose.

The Customer's bank details are transmitted in encrypted form and processed directly by the payment provider and the financial institutions concerned. The seller does not have access to the Customer's full bank details and does not store them. Payment is subject to acceptance by the issuer of the payment method used. If payment is refused, authorization fails, or fraud is suspected, the seller may suspend or cancel the order, without this giving rise to any compensation.

Any fees, commissions, or exchange differences charged by the Customer's bank or by the issuer of the payment method — in particular when the account is held in a currency other than the euro or outside the euro area — are not collected by the seller. They are not sums paid to the seller and cannot give rise to any refund by the seller, including if the order is cancelled, withdrawn, or refunded.

7. Availability of the products

Product offers are valid for as long as they are visible on the Site, within the limits of available stock. If a product is unavailable after the order is placed, the seller informs the Customer by email as soon as possible. The order is then automatically cancelled for the product concerned, and the Customer is refunded any sums paid for that product, at the latest within fourteen (14) days of the date the cancellation was notified, with no other compensation or penalty.

8. Delivery

Products are delivered to the address the Customer gives when ordering. Delivery is free in metropolitan France. The delivery time observed is generally between five (5) and fifteen (15) days from confirmation of the order, provided the price has been paid in full.

These times are given as a guide and may vary depending on the destination, the carrier, and circumstances outside the seller's control. Full details, the areas served, and shipment tracking are set out on the Delivery page. If delivery is unusually late, the Customer is invited to contact customer service at hello@thelittlenight.com so the situation can be looked at. On receipt, the Customer is invited to check the condition and conformity of the products and to report any obvious issue without delay.

Refusal of the parcel and unclaimed parcel. It is the Customer's responsibility to receive the parcel or to collect it within the time the carrier indicates when it is held at a pickup point. If the parcel is refused on delivery, not collected in time, or delivery fails for a reason attributable to the Customer (wrong or incomplete address, recipient cannot be found), the carrier returns the parcel to the seller. In that case, the return costs charged to the seller by the carrier are borne by the Customer. If the Customer wants the parcel sent again, the reshipping cost is communicated in advance and remains the Customer's responsibility. If the Customer wants a refund of the order, they must notify withdrawal under article 9: the refund is then made after the parcel has actually returned to the seller's warehouse, minus the return costs mentioned above. Refusing the parcel is not, by itself, notice of withdrawal.

9. Right of withdrawal

Under the legal rules that apply to distance selling, the Customer has fourteen (14) days to exercise the right of withdrawal, without having to give a reason and without having to bear any costs other than those set out below. The period starts on the day the Customer, or a third party they designate other than the carrier, takes physical possession of the product. When the order covers several products delivered separately, the period starts on receipt of the last product.

To exercise the right of withdrawal, the Customer notifies the seller by a clear statement, by email to hello@thelittlenight.com. They may use the model withdrawal form below, but they do not have to. To meet the deadline, it is enough that the Customer sends the statement before the fourteen (14) days expire.

If they withdraw, the Customer sends the product back without undue delay and, in any event, no later than fourteen (14) days after telling the seller they are withdrawing. The direct cost of returning the product is borne by the Customer. The product must come back complete, in a condition that allows it to be put back on sale. The seller refunds the sums the Customer paid for the returned product, subject to the deduction for loss of value set out below, at the latest fourteen (14) days from the date the seller is informed of the decision to withdraw. The refund may be delayed until the product is recovered or until the Customer has provided proof of shipment, whichever comes first. The refund is made using the same payment method as the original transaction, unless the Customer expressly agrees to another method.

Depreciation of the returned product.Under article L.221-23 of the French Consumer Code, the Customer is liable for any loss of value resulting from handling other than what is necessary to establish the nature, characteristics, and proper working of the product. The Customer may unpack the product and examine it as they could have done in a store, and that opening alone does not lead to any deduction. The products sold on the Site are bedding items in direct and prolonged contact with a child's face and airways: actually using them, in particular having a child sleep on them, even for a single night, goes beyond the handling needed to try the product and makes it unfit to be put back on sale for hygiene reasons — the same pillow cannot be offered to another family. That use causes a major loss of value, which is deducted from the refund.

The deduction is assessed case by case, based on the actual condition of the product when the return is received, using the following indicative scale:

  • Product never used, complete, clean, and fit to be put back on sale: no deduction. The product price is refunded in full.
  • Product used, even if it comes back clean and complete: a deduction of seventy-five percent (75%) of the product value, meaning a refund of twenty-five percent (25%) of the price paid for that product.
  • Product stained, smelly, washed, damaged, or incomplete: the deduction may reach the full price of the product, which can neither be checked nor put back into circulation.

The deduction cannot exceed the price paid for the product concerned. The condition of the product is recorded and documented when the return parcel is opened, and the deduction is explained to the Customer before it is applied.

Practical arrangements for sending it back. The Customer is invited to submit the request from the Returns & Refunds page, which identifies the order and collects the information needed to handle the file. Using that form is not a condition of the right of withdrawal: withdrawal can always be notified by a simple email to hello@thelittlenight.com, and that notice is recorded on the date it is sent. The return address is given to the Customer after the request is recorded. The Customer includes a readable note of their name and order number in the parcel, so it can be identified and matched to the file on arrival. The Customer keeps proof of shipment.

Model withdrawal form.A Customer who wishes to withdraw may copy and complete the following text, then send it to the seller: "To Kyronix Labs LLC, email hello@thelittlenight.com: I hereby notify you of my withdrawal from the contract for the sale of the goods below. Ordered on (date) / received on (date). Order number (number). Customer name. Customer address. Date. Signature (only if this form is notified on paper)."

10. Commercial guarantee "30-night trial"

In addition to the legal right of withdrawal in article 9, and independently of it, the seller grants the Customer a commercial guarantee called the "30-night trial". It lets the Customer try the product at home for thirty (30) nights from receipt and, if the product does not suit them, benefit from the solutions described in this article. This commercial guarantee is optional and freely given by the seller, who sets its conditions. It does not replace the right of withdrawal or the legal warranties, and it does not take any of those rights away from the Customer.

Solutions offered under the guarantee.Depending on the Customer's situation, the seller offers:

  • Personalized supportin getting started with the product: choosing the size, setting it up in the bed, and the child's adjustment period.
  • A free size exchange. If the size chosen does not suit the child and the product has not been used, the seller arranges the exchange and covers the cost, under the conditions set out on the Returns page.
  • A refund whose amount depends on the condition of the product. The product sold is a bedding item in direct contact with a child's face and airways: once used, it can no longer be offered to another family for hygiene reasons. The seller therefore refunds the full product price if it has never been used and can be put back on sale; twenty-five percent (25%) of the price paid for the product if it has been used, even if it comes back clean and complete; and nothing under this guarantee for a product that is stained, washed, damaged, or incomplete.
  • Where appropriate, an alternative solution: a credit, a replacement, or a commercial gesture, which the Customer is free to accept or refuse. Express acceptance of such a solution settles the request made under this commercial guarantee.

Conditions of implementation. This guarantee applies only if all of the following conditions are met:

  • An effective trial. Because the product accompanies a child falling asleep, an adjustment period is needed to judge its effect. The guarantee assumes a trial of at least ten (10) nights from receipt. Before that, the seller helps the Customer get started with the product. The request can be recorded and taken up again once the tenth night is reached.
  • A formalized request. The request is submitted from the Returns & Refunds page, within thirty (30) nights of receipt, and includes information about how the product was used.
  • A video finding. The seller asks for a short video of the product, recorded in a single take and following the instructions given when the request is submitted, so the real condition of the product and the reason given can be confirmed. This check can allow the seller to refund the Customer without requiring the product to be sent back, in which case the Customer keeps the product. If the check is not sufficient, the guarantee requires the product to be actually returned, and the condition that counts is the one observed when the return is received.
  • Costs and condition of the return. When a return is made under this guarantee, return shipping is at the Customer's expense, except for a size exchange. The product is returned clean, complete, protected for transport, with the Customer's name and order number.

The practical steps are set out on the Guarantee and Returnspages. Not meeting the conditions of this commercial guarantee does not take away the Customer's right of withdrawal under article 9, or the legal warranties under article 11, which remain available in every case.

11. Legal guarantees

Independently of the commercial guarantee, the Customer always benefits from the legal warranties attached to the sale. The product sold is covered by the legal warranty of conformity, under articles L.217-1 and following of the French Consumer Code, and by the warranty against hidden defects, under articles 1641 and following of the French Civil Code. These warranties apply independently of any commercial guarantee.

Under the legal warranty of conformity, the Customer may obtain repair or replacement of the non-conforming product and, failing that, a price reduction or cancellation of the sale, under the conditions provided by law. Under the warranty against hidden defects, the Customer may choose between cancellation of the sale and a reduction of the sale price, in accordance with those articles.

When the product delivered does not match the order or has a defect covered by the legal warranties, return of the product and the corresponding refund are covered at the seller's expense. To use a legal warranty, the Customer sends the request, with the useful details, to hello@thelittlenight.com.

12. Customer service and complaints

For any question, request for information, or complaint about an order, a product, or performance of these Terms, the Customer can contact customer service by email at hello@thelittlenight.com. The seller aims to reply as soon as possible and, first, to look for an amicable solution to any difficulty. The Customer can also use the Write to us page to send a request.

13. Personal data

The personal data the Customer provides when ordering is needed to process the order, deliver it, invoice it, and manage the customer relationship. It is processed in accordance with the applicable data protection rules. The Customer has rights over their data, including rights of access, rectification, and erasure. How the data is processed, how long it is kept, and how to exercise those rights are set out on the Privacy Policy page. Information about trackers and cookies is set out on the cookies page.

14. Intellectual property

All elements that make up the Site — in particular the "The Little Night" brand, logos, texts, visuals, photographs, illustrations, graphic identity, and the structure of the Site — are protected by intellectual property law. These elements are the exclusive property of the seller or its partners, who hold the rights or have the authorizations needed to use them.

Any reproduction, representation, adaptation, modification, distribution, or use, in whole or in part, of these elements, by any process and on any medium, without the seller's prior written authorization, is prohibited and may constitute infringement for which the author is liable. Placing an order gives the Customer no intellectual property right over the elements of the Site.

15. Responsibility

In the context of the sale, the seller is bound by an obligation of means. The seller cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a service interruption, an external intrusion, or the presence of computer viruses, nor for damage resulting from use of the product that does not follow its intended purpose, the recommendations for use, or the care instructions in the product description.

The seller cannot be held responsible for non-performance of the contract in a case of force majeure within the meaning of article 16, or because of a fact attributable to the Customer, or because of an unforeseeable and insurmountable act of a third party to the contract. These provisions cannot, however, exclude or limit the seller's liability in cases where such an exclusion or limitation is prohibited by law, in particular under the legal warranties and mandatory legal obligations.

16. Force majeure

The seller's liability cannot be engaged if non-performance or delay in performing one of its obligations results from force majeure. Force majeure includes events beyond the parties' control, which could not reasonably have been foreseen when the contract was concluded, and whose effects cannot be avoided by appropriate measures, when they prevent a party from performing its obligations.

The party that invokes force majeure informs the other party as soon as possible. Performance of the affected obligations is suspended for the duration of the force majeure event. If the obstacle is permanent or lasts beyond a reasonable time, the contract is terminated automatically and the parties are released from their obligations, and the Customer is refunded any sums paid for products that were not delivered.

17. Consumer mediation and settlement of disputes

If there is a dispute about an order, the Customer is invited to contact customer service first at hello@thelittlenight.com to look for an amicable solution. If no amicable agreement is reached, a consumer Customer residing in the European Union is informed of the online dispute resolution (ODR) platform made available by the European Commission, intended to receive consumer complaints following an online purchase and, where appropriate, to forward them to a competent body. Using an amicable dispute-resolution method remains optional and does not prevent the Customer from bringing the matter before the competent courts.

18. Applicable law and competent jurisdiction

These Terms and the sales contracts concluded with consumer Customers are governed by the provisions applicable to consumer protection. When the Customer is a consumer and resides in the European Union, they benefit from the protection of the mandatory provisions of the law of the country of their habitual residence, and no provision of these Terms can deprive them of that protection.

If no amicable resolution is reached, any dispute relating to the formation, interpretation, or performance of these Terms will be brought before the competent court in accordance with the applicable rules of law. The consumer Customer always retains the right to bring the matter before the court of their place of residence or of the place of delivery of the product, under the conditions provided by law.

19. Modification of the general conditions of sale

The seller may change these Terms at any time, in particular to reflect any change in the law, in regulations, or in its offer. The Terms that apply to an order are those accepted by the Customer when that order is confirmed. Any order placed after an update of the Terms constitutes acceptance of the Terms then in force. The Customer is therefore invited to read this page before each order, as well as the last-updated date shown at the top of the page.
